Ohio legal victory

Let it be said again -- Republicans seek to decrease voter turnout, Democrats seek to increase it.
Republicans lost an attempt Friday to restart hearings on thousands of voter registrations contested by the GOP, and the court's action could mean the hearings will never be held. The 6th Circuit Court of Appeals in Cincinnati turned down several Republican appeals, clearing the way for a lower-court judge to decide whether to extend her temporary order stopping the hearings.

A federal judge in Columbus blocked Republican efforts to force county election boards to review tens of thousands of new voter registrations. Before the ink was dry on the judge's order, the Ohio GOP's top lawyer said the action meant the GOP would challenge such voters at the polls on November 2. "We wanted to have all these questions resolved this week," said attorney Mark Weaver. "Now they won't be resolved until Tuesday, when all of these people are trying to vote. It can't help but create chaos, longer lines and frustration."
In other words, the GOP is using the demise of one prong of its voter supression strategy to pre-justify the other.

The Cuyahoga County Board of Elections must find more than 17,000 registered voters by Friday to tell them they may be culled from the rolls by Republican challengers.
Registration hearings trying to be scheduled (info on Cuyahoga, Summit and Franklin counties) 17,000 voters have been challenged in Cuyahoga, 1000 in Summit and 2400 in Franklin. Each voter must show up and prove who they are, etc...

Ohio GOP Drops Registration Challenges

State Republicans withdrew thousands of more than 35,000 challenges to new voter registrations because of errors in their filings apparently caused by a computer glitch.
Republicans filed the challenges Friday in 65 of Ohio's 88 counties, saying mail sent to the newly registered voters was returned as undeliverable.

Blackwell criticized AGAIN over his handling. Over 1000 marchers descended on Blackwell's offices to demand changes in instructions given to county elections officials about challenging voters and provisionally casting ballots if needed.

"I cannot be confident . . . that Blackwell will, indeed, fulfill his obligation to this court, Ohio's election officials, and Ohio's voters," the judge wrote.


Yesterday, U.S. District Judge James Carr ruled in favor of the Ohio Democratic Party. It appears that Carr wisely crafted a compromise that, on one hand, errs on the side of the the voter by granting them a provisional ballot if they appear at the wrong precinct. On the other hand, Carr's ruling will prevent possible voter fraud by not counting the vote in the jurisdiction where the voter shows up on election day.
In other words, a provisional voter that is confirmed to be a registered voter will have his or her vote counted for federal office purposes (e.g., the presidency, congress and the senate) but the vote won't be counted if there is a local liquor license up for a vote in that precinct.

The Florida Supreme Court ruled otherwise for its state's voters.

Six people connected with the South Dakota republican party have resigned over questions surrounding absentee ballot applications. The state director of the Republican Victory Program, Larry Russell is one of them...

Many absentee ballot applications are what led to a half dozen resignations. The people involved in securing the forms may not have always made sure a commissioned notary witnessed the voters' signatures.

Now Larry Russell has been shuffled to Ohio with three of five other Republican operatives who resigned in South Dakota. They will now be running the Ohio get-out-the-vote operation. more info

Confusing Absentee Ballots

Ohio really is the new Florida.

Monday, October 18th, I received my absentee ballot here in Boston, since I am registered to vote in Cuyahoga County, Ohio, where I am from originally. I had always seen my parents line up the arrows with the punch card in the voting booth, and I had done the same on several previous occasions voting absentee from school. This time, on my ballot, if you used the arrows that were provided to you, the numbers on the ballot and the numbers on the punch card did not line up. In some cases, they were exactly reversed.

Misleading Phone calls giving wrong polling places

Kerry left off some absentee ballots

Some absentee ballots distributed to Hamilton County voters do not include the name of Democratic presidential candidate John Kerry, local election officials confirmed today.

Because of a printing error -- limited, election officials believe, to only a few ballots in the Forest Park area -- absentee ballots recently mailed out exclude the Democratic presidential ticket of Kerry and his running mate, Sen. John Edwards.

"It's a screw-up," said Tim Burke, chairman of the Hamilton County Board of Elections. "This just feeds the paranoia that's out there. The tragic thing is that even though I think we will have a very fair and accurate count here, this will cause people to question the accuracy of our operation."
