Bush v Gore-Concurrence Rehnquist

This Rehnquist opinion, joined by Scalia and Thomas argues that legislatures and not the courts should have a role in resolving election disputes. It was echoed in a dissent to a denial of certiorari from the U.S. Supreme Court in an case where the Colorado legislature had tried to redistrict more than once in a decade because a court had been forced to draw the original boundaries when the legislature failed to do so.
